How to transfer vehicle registration from one person to another

If you are selling your vehicle, it is mandatory to get the ownership of the vehicle transferred to the new owner. It is done through a process known as RC Transfer. It is important because it ensures that the vehicle and all legal liabilities related to it are transferred to the buyer. What are the circumstances under which the transfer of ownership of the vehicle is done?

Below given are the different circumstances under which the transfer of ownership of the vehicle might happen:

  • Transfer of ownership of the vehicle if it is purchased by someone else: In this situation, the name of the new buyer is added to the registration certificate as the owner of the vehicle in place of the name of the previous owner.
  • Transfer of ownership in the case of death of the registered owner: Here, the legal heir is required to inform the registering authority about his/her intention to become the owner of the vehicle within 30 days of owner’s demise. The legal heir can utilize the vehicle under his/ her possession for a maximum period of 3 months.
  • Transfer of ownership of the vehicle in an auction: Here, the name of the new owner is added to the registration certificate.

Process and documents required for the transfer of ownership of the vehicle-

The process and the documents required for transferring ownership of the vehicle is different for different cases.

  • Transfer of ownership of the vehicle in case it is purchased by someone else: In this case, Form 29 needs to be submitted with the mentioning of all the details of the transferor and transferee.
  • Transfer of ownership if the owner of the vehicle is deceased: In this case, the new owner of the vehicle needs to submit Form 31 to the registering authority by filling all the details required to be filled in the form. After that, the new owner of the vehicle is required to submit the form for the transfer of ownership within 3 months of taking actual ownership of the vehicle along with the required fee.
  • Transfer of ownership of the vehicle in an auction: Here, if the vehicle is purchased at a Central or State Government sponsored auction, the application for the transfer of ownership needs to be submitted via Form 32. The form should be submitted to the registering authority within 30 days of purchase of the vehicle along with a small fee.
  • Transfer of ownership of the vehicle within the state: In this case, the transferee needs to submit Form 30 within 14 days of the transfer along with the documents that need to be submitted under Form 1.
  • Transfer of ownership of the vehicle outside the state: In this case, the transferee will have to submit Form 30 within 45 days of the transfer along with the documents that have to be submitted under Form 1 and Form 2 along with the required fee.

Process of transferring the vehicle registration from one state to another

Here, you will know about the process of transferring your vehicle registration from one state to another. This is the process that you need to follow if you are moving from one state to another- 

Step 1: Get the No Objection Certificate from the bank (if you have taken a loan)

If you have taken a loan on your vehicle, you will first need to obtain a NOC from your bank. For this, you will need to visit the bank and submit documents such as the address proof in the new city, your reason for transfer, etc.  After submitting the documents, the bank will process your request and then grant you the NOC.

Step 2: Obtain a NOC from the Regional Transport Office where your vehicle was registered

After getting the NOC from the lender, you will need to avail of the NOC from your RTO. For example, if you are moving from Mumbai to Delhi, you will need to obtain the NOC from Mumbai RTO. For this, you will have to submit Form 27 and 28 and the NOC copy obtained from your bank.

You will also need to submit the following documents mentioned below:

  • NOC application for transferring your vehicle from one state to another
  • Documents such as registration certificate, insurance policy documents, tax documents, pollution under control certificate
  • Vehicle’s chassis imprint
  • Copies of CMV Form 28
  • After obtaining the NOC from RTO, you can move the registration of your vehicle from your state to the new state.

Step 3: Re-Registering your vehicle in the new city

After transferring your vehicle successfully, you will need to undertake the following steps to get it re-registered in the new state. For the re-registration, you will first need to locate your nearest RTO office and submit your application along with the following documents:

  • The copy of your original RC of the vehicle
  • The copy of your vehicle insurance policy
  • Copy of the NOC if you have already received from your lender, previous RTO, etc
  • Form 29 and Form 30 to re-register your vehicle
  • Certificate for undertaking emission tests
  • Passport size photographs
  • Local address proof
  • Applicable RTO charges for transfer of vehicles

After submitting the documents successfully, your RTO will process your application and issue you with the fresh certification within a few days.
